1 — SASU Domaine de Buffières operates the Domaine Dolomieu reservation site, www.domaine-dolomieu.com . This website presents the area and allows the reservation of rooms and services online.

2 — The Customer declares that he has obtained from SASU Domaine de Buffières, all the information necessary to make his choice and continue with his reservation, on this website.

3 — Any reservation made through the site www.domaine-dolomieu.com  implies consultation and full and unreserved acceptance of these general conditions as well as the conditions of sale of the reserved rate expressly mentioned in the description of the rate selected at the time of the reservation.

4 — The Customer must confirm by checking the box, have read and accept these general conditions and the conditions of sale of the reserved rate before definitively validating his reservation; no reservation is possible without this agreement.

5 — The Customer has the option of saving and editing these general conditions using the standard functionalities of his browser or computer.

6 — The following information appears on the site:

7 — The Customer, prior to booking declares that this booking is made for his personal needs. The Customer, by its status of consumer, has specific rights, which would be called into question in the event that the services reserved are not for personal purposes.

8 — All the information accessible on the site www.domaine-dolomieu.com  is presented in French and English.

9 — The Customer declares to have full legal capacity allowing him to commit under these general conditions.

Definitions

For the rest of the present, the terms below will have the following meaning:

"Reservation confirmation": dematerialized document which summarizes the characteristics of the services reserved by the Customer on the site www.domaine-dolomieu.com. This document precedes the acceptance by the Customer of these general conditions of sale and the entry by the Customer of his banking information in the context of a prepayment or a guarantee. Object

1 — These general conditions define the rights and obligations of the parties in connection with the remote booking of services offered by Domaine Dolomieu on the website www.domaine-dolomieu.com

2 — They govern all the stages necessary for the reservation and the follow-up of the reservation between the contracting parties.

3 — The Customer acknowledges having read and accepted these general conditions of sale and the conditions of sale of the reserved rate available on the site www.domaine-dolomieu.com.

Duration

1 — These general conditions of sale apply for the entire duration of the online services of Domaine Dolomieu on the website www.domaine-dolomieu.com.

2 — SASU Domaine de Buffières reserves the right, without notice or compensation, to make changes to these general conditions of sale, to temporarily or permanently close the website www.domaine-dolomieu.com or the reservation area online. To this end, we invite you to consult them regularly.

3 — SASU Domaine de Buffières is not responsible for damages of any kind that may result from these changes and / or temporary unavailability or from the definitive closure of all or part of the site or the services associated with it. , such as the online booking space.

Reservation

1 — The Customer chooses services from those offered by Domaine Dolomieu and presented on the website www.domaine-dolomieu.com according to his needs.

2 — The Customer acknowledges having read the nature, destination and booking methods of the services available on the website and having requested and obtained the necessary and / or additional information to make his reservation with full knowledge of the facts.

3 — The Customer may reserve, on the www.domaine-dolomieu.com site, individually, a maximum of three (3) rooms per reservation. For any reservation of a higher number of rooms, the Customer can request to be contacted by the sales teams, by filling in the online contact form.

4 — The Customer is solely responsible for his choice of services and their suitability for his needs, so that the responsibility of the selected SASU Domaine de Buffières cannot be sought in this regard.

Reservation process

1 — The reservation made by the Customer is made through the reservation module accessible online on the website www.domaine-dolomieu.com

2 — The reservation is deemed to have been made upon receipt by the Customer of its confirmation of receipt sent by the Domaine Dolomieu.

3 — The Customer undertakes, prior to any reservation, to complete the compulsory information requested on the reservation module.

4 — The Customer certifies the veracity and accuracy of the information transmitted.

5 — The booking procedure includes the following steps in particular:

  • Step 1. Search via the website, the choice of room and the conditions of sale of the reserved rate,
  • Step 2. Selection, if necessary, of one or more additional services
  • Step 3. Verification of the summary of the reservation, its total price, the conditions of sale of the reserved rate which includes in particular the payment conditions and the cancellation conditions, modifications if necessary of the choice of services (date, room, price , additional service),
  • Step 4. Information of the Customer's contact details,
  • Step 5. Consultation and acceptance of the general conditions of sale,
  • Step 6. Entering the bank card in the event of a guarantee or prepayment request,
  • Step 7. Confirmation and Validation of the reservation and payment by the Customer,
  • Step 8: Receipt by the Customer of the acknowledgment of his reservation confirmation. This booking confirmation summarizes the contract offer, the services reserved, the prices, the conditions of sale relating to the selected rate, accepted by the Customer, as well as the address of the seller's establishment with which the Customer can present his complaints
     

Cancellation or modification by the Client

1 — The Customer is reminded, in accordance with article L. 121-20-4 of the Consumer Code, that he does not have the right of withdrawal provided for in article L. 121-20 of the Code of consumption.

2 — The Customer is also reminded that the conditions of sale of the rate reserved and accepted by the Customer, specify the terms of cancellation and / or modification of the reservation.

3 — Reservations with prepayment may not be subject to any modification and / or cancellation. The amounts paid in advance, which are the deposit, will not be subject to any refund. In this case, it is mentioned in the conditions of sale of the reserved rate.

4 —When the conditions of sale of the reserved rate allow it:

  • the cancellation of the reservation can be made directly on the website www.domaine-dolomieu.com through the "Your reservations" section;
  • the modification of the reservation can be made directly with the Domaine Dolomieu, the telephone details of which are specified on the confirmation of reservation received from the Domaine Dolomieu.

5 — In case of interruption of the stay, the entire agreed price will be cashed. In the case of reservation with prepayment, no refund will be granted as a result.

6 — In the event of a no show, that is to say in the case of a reservation not canceled but for which the client does not
did not show up at the Hotel on the day reserved and insofar as the reservation has been guaranteed by credit card, Domaine Dolomieu will debit the amount corresponding to 100% of the stay booked as compensation due for the damage suffered because of the no show.

7 — Cancellation by Domaine Dolomieu: In the event of an exceptional event or the impossibility of making the reserved room available to the Client, in the event of force majeure, Domaine Dolomieu may offer the Client a solution for accommodation in a hotel of at least equivalent category, or if it is of a lower category, a room of a level higher than that originally reserved, for services of the same kind. All possible additional costs attached to this removal, for services of the same kind, will be covered by the Domaine Dolomieu
without being able to be sought in payment of any additional compensation.

8 — All reservations are nominative and cannot in any case be transferred to a third party, either free of charge or for a fee. All reservations made for others must be made in the name of the third party holder of the stay.

Stay at Domaine Dolomieu

1 — In accordance with the regulations in force in certain countries, the Customer will be asked, upon arrival at Domaine Dolomieu, to complete an information sheet and to ask the Customer to present an identity document.

2 — The Domaine Dolomieu welcomes small pets as long as they are kept on a leash or in a cage in all the common areas of the establishment. For hygienic reasons, animals are not allowed in the catering rooms, as well as in the spa.

3 — The Customer accepts and agrees to use the room and the common areas made available to him, in perfect condition of good citizenship and good education. Any behavior contrary to the principles of safety and / or hygiene, good customs and / or public order may lead the Domaine Dolomieu to ask the Customer to leave the establishment without any compensation and / or without any refund if a payment has already been made

4 — Any damage caused by the Customer in the reserved room may be billed directly to him.

5 — Penalties equal to the maximum, at the price of the reserved room may be applied if the Customer does not comply with the display prescribing the ban on smoking in his room, when the latter is displayed.

6 — Unless expressly provided otherwise, the Customer must vacate the room no later than 12.00 noon on the day of the end of the reservation. Otherwise, he will be billed for an additional night.

7 — Guarantees
Domaine Dolomieu is required to guarantee the conformity of services, under the conditions set out in article L. 212-1 of the Consumer Code

Liability

1 — The photographs presented on the website www.domaine-dolomieu.com are not contractual. Even if all the best efforts are made so that the photographs, graphic representations and the texts reproduced to illustrate the Domaine Dolomieu, give as exact an overview as possible of the accommodation services offered, variations may occur, in particular due to the change of furniture or any renovations. The Customer cannot claim any claim for this fact.

2 — In accordance with the laws and regulations governing intellectual property rights, the use and / or reproduction of all or part of the elements making up the offers from Domaine Dolomieu present on the Website are strictly prohibited.

3 — SASU Domaine de Buffières will not be liable for any indirect damage caused by this agreement, in particular by a third party, by the Customer or by the partners of Domaine Dolomieu

4 — Hypertext links may refer to sites other than the Domaine Dolomieu site, which disclaims all responsibility for the content of these sites and the services offered. SASU Domaine de Buffières has implemented measures to protect and security their information system against malicious acts, however, connecting to the website and making a reservation implies for the Client, knowledge and acceptance of the characteristics and limits of the Internet, the absence of protection of certain data against possible misappropriation or hacking or risks of contamination by possible viruses circulating on the network.
SASU Domaine de Buffières declines all responsibility in the event of misuse or of an incident related to the use of the computer or any medium allowing access to the Internet, maintenance or malfunction of the website or any other technical connection and sending information to the wrong address

5 — Any reservation or payment that is irregular, ineffective, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the order at the Customer's expense, without prejudice to any civil or criminal action against the latter.

6 — Within the framework of his reservation and his stay, the Customer undertakes to behave in a perfect state of good citizenship and good education and not to harm in any way the members of the team of Domaine Dolomieu as well than to third parties present in the establishment. Such behavior may lead the Domaine Dolomieu to expel the Customer outside the Hotel without this Customer being able to claim any right to compensation.

Prices

1 — The prices relating to the reservation of the services are indicated before and during the reservation.

2 — The prices indicated are per room for the number of person (s) and the date (s) selected.

3 — The prices are confirmed to the Customer all taxes included (TTC), in the commercial currency of Domaine Dolomieu, and are only valid for the duration indicated on the site.

4 — If the debit is made at Domaine Dolomieu in a currency other than that confirmed on the reservation, the exchange costs are the responsibility of the Customer.

5 — All reservations, whatever their origin, are payable in the local currency of the establishment, unless special provisions indicated on site.

6 — Conversion into foreign currency is given for information only and is not contractual. Only the currency confirmed during the reservation is guaranteed (if this currency is different from that used at the hotel, any exchange costs will be charged to the Customer).

7 — If a price implies that payment is made at the hotel at the time of the Customer's arrival or departure and that the Customer's currency is not the same as that of the hotel, the price debited by the hotel is
likely to be different from that communicated during the reservation, taking into account the possible evolution of the exchange rates between the date of reservation and the dates of stay at the hotel.

8 — Unless otherwise stated, additional services (breakfast, half-board, full-board, etc.) are not included in the price

Payment

1 — Unless conditions or special rates selected, the Customer communicates his bank details as a guarantee of the reservation, by credit or private bank card (Visa, Mastercard and American Express), indicating directly in the area provided for this purpose ( secure entry by SSL encryption), the card number, without spaces between the numbers, as well as its validity date (it is recalled that the bank card used must be valid at the time of the stay) and the visual cryptogram in the context of prepayment via the secure payment platform, Secure Socket Layer (SSL). On the day of arrival at Domaine Dolomieu, the Customer must present himself with the bank card that enabled him to guarantee the reservation or to make the prepayment.
Domaine Dolomieu may also ask him to present an identity document for the purpose of preventing credit card fraud

2 — The debit of payment is made at Domaine Dolomieu during the stay, except in the case of conditions or special rates or the debit of payment is made during the reservation (online prepayment on certain rates). This prepayment is called a deposit. In the case of a non-prepaid online rate, the Domaine Dolomieu may ask the Customer, upon arrival, for a security deposit or authorization to debit the credit card in order to guarantee payment of the sums corresponding to the services consumed on the spot.

3 — SASU Domaine de Buffières has chosen a third-party service provider (Payment Service Provider) to secure online payments by bank card. The validity of the Customer's payment card is verified by this service provider. There may be a refusal of the payment card for several reasons: stolen card, blocked card, ceiling reached, input error, etc. In the event of a problem, the Customer must contact their bank on the one hand, the hotel on the other hand, to confirm his reservation and his method of payment.

4 — At the time of prepayment, the amount which is debited during the reservation includes: the price of the service, the related taxes, the price of the catering if breakfast is chosen, the taxes related to the catering and all other services additional items selected by the Customer excluding tourist tax and / or any other tax that would be due as a result of the Customer's stay at Domaine Dolomieu.

Personal data

1 — Your personal data requested within the framework of your reservation, namely your civility, last name, first name, your telephone number with country code, your e-mail address, your credit card references (Number, type of card, name of the holder, expiration date and cryptogram), in the event that they are transmitted to us, as well as any data communicated on our website or generated by your browsing constitute confidential data.

2 — They are accessible to SASU Domaine de Buffières, as mentioned in our confidentiality policy, acting as data controllers, in order to allow the management of your reservation, to respond to your requests and to send you commercial offers. .

3 — The answer to questions marked with an asterisk (*) is mandatory, otherwise we will not be able to process your request or your reservation. Your data will be processed by Domaine Dolomieu staff, marketing teams and their partners.

4 — In accordance with the amended "Information Technology and Liberties" law of January 6, 1978, you have the right to access, rectify and delete data, to request a limitation on the processing of personal data concerning you. You also have the right to object to the processing of your data for legitimate reasons and the right to object to the processing of your data for commercial prospecting purposes. Evidence agreement

1 — The entry of the required bank information, as well as the acceptance of these general conditions and the booking confirmation, constitutes acceptance of the contract, between the parties, having the same value as a handwritten signature.

2 — The computerized registers kept in the computer systems of SASU Domaine de Buffières will be kept under reasonable security conditions and considered as proof of communications, orders and payments made between the parties.

Force majeure

SASU Domaine de Buffières cannot be held liable in relation to the Client in the event of non-performance of its obligations resulting from an event of force majeure.
Likewise, the Customer cannot be held responsible towards SASU Domaine de Buffières, in the event of non-performance of its obligations resulting from an event of force majeure.
Are considered force majeure or fortuitous event those usually recognized by the jurisprudence of the French Courts.

Applicable law

1 — These General Conditions of Sale are governed by French law.

2 — This is so for the substantive rules as for the rules of form

Completeness

1 — These General Conditions of Sale, the conditions of sale of the rate reserved by the Customer, and the acceptance of the booking confirmation express the entire obligations of the parties.

2 — No general or specific condition communicated by the Customer may be incorporated into these general conditions.

3 — The document forming the contractual commitments between the parties is the booking confirmation (including the special conditions of the reserved rate) which has been subject to validation by the Client and these general conditions.

4 — In the event of a contradiction between the booking confirmation and the general conditions, the provisions appearing on the booking confirmation, validated by the Client are the only ones applicable for the obligation in question.

Evolution / Modification of the General Conditions of Internet Sales

These General Terms and Conditions of Sale may be modified and / or supplemented by SASU Domaine de Buffières at any time. In this case, the new version of the General Conditions of Internet Sales will be put online by SASU Domaine de Buffières. As soon as it is posted on the internet, the new version of the General Terms and Conditions of Internet Sales will automatically apply to all Customers

Attribution of jurisdiction

 In the event of a dispute, arising both in the interpretation and in the execution of these general conditions of sale, and in the absence of an amicable agreement, the PARTIES decide that the dispute falls under French law and attribute exclusive jurisdiction to the Commercial Court of Vienna.
